Over 90% of disputes resolved in just one day
In most cases, mediation lasts for one full day. Experience has shown us that entrenched positions can be adopted when problems are overlooked or inflamed, whereas a fully trained and skilled TCM mediator can help your employees move towards a more constructive and satisfactory resolution. We resolve 93% of disputes referred to us and these typically involve complex issues such as grievances, complaints and allegations of bullying,and harassment.
What issues are suitable for mediation?

The characteristics of FAIR mediation
- Most FAIR mediation's occur over one full day.
- FAIR mediation is a confidential process which encourages open and honest dialogue.
- FAIR mediators don't judge or blame the parties, instead they invite empathy and encourage dialogue.
- FAIR mediators secure a written, signed agreement in over 90% of the disputes in which they mediate.
- It has taken us many years to get this model right and we now train over 500 mediators a year to be FAIR mediators.

How are companies using mediation?
As a result of recent guidance from The Department for Business (BIS) and the CIPD, many employers now have mediation written into their policies and use mediators to seek a formal remedy to workplace disputes. Whilst simplicity is key, each element of mediation requires great care and professionalism to ensure that the process is effective.
TCM's FAIR mediation process comprises 4 simple stages. These are set out below:
1: The referral/request to mediate |

2: Preparing to mediate |
Our fully accredited mediators undertake extensive preparation to ensure that mediation is effective. |
3: The joint mediation meeting |
We mediate over one full day using a mixture of separate and joint meetings. |
4: Post mediation |
We follow up on a regular basis and support you and the parties for a full twelve months. Our follow up service is industry leading and ensures that mediation agreements are sustained. |
Professional Mediation Standards
TCM's mediators are full members of the Professional Mediators' Association (PMA). The PMA is the standard bearer for professional mediation standards across the UK and is recognised by CIPD and UK Government. The approved professional mediator practice standards are available to download for free in the downloads section on this page.
TCM also subscribes to the EU's Code of Practice for Mediators and we are registered with the Civil Mediation Council.

Employment Act 2008
Following the Gibbons Review (2007), the Employment Act 2008 signifies a more flexible system for resolving workplace disputes.
An enhanced role for mediation and early resolution
For many years, TCM has been advocating an increased role or mediation as an alternative to time consuming and stressful grievance procedures and Employment Tribunals. We are delighted that mediation will now be taking a more prominent role in UK workplaces. The new system will emphasise the importance of early dispute resolution, for example through workplace mediation. Employers will be asked to offer informal dispute resolution mechanisms either through the provision of external or internal mediation.
The proposed benefits of the revised system will be that they are simpler and less prescriptive and that they offer greater flexibility to informally resolve conflicts at work. Our hope is that this will result in cost and time savings and that it will also reduce the stress of going through an Employment Tribunal.
