Employment Act 2008
Following the
Gibbons Review (2007), the Employment Act 2008 signifies a more flexible system for resolving workplace disputes.
An enhanced role for mediation and early resolution
For many years, TCM has been advocating an increased role or mediation as an alternative to time consuming and stressful grievance procedures and Employment Tribunals. We are delighted that mediation will now be taking a more prominent role in UK workplaces. The new system will emphasise the importance of early dispute resolution, for example through workplace mediation. Employers will be asked to offer informal dispute resolution mechanisms either through the provision of
external or
internal mediation.
The proposed benefits of the revised system will be that they are simpler and less prescriptive and that they offer greater flexibility to informally resolve conflicts at work. Our hope is that this will result in cost and time savings and that it will also reduce the stress of going through an Employment Tribunal.
